Original Massager— From: Bien Gesmer (manto;Egesmer^gulges.eom] Sani: Friday, May 17. 2002 12:51 AM Tot Rutkin, Amy Cet agesmer^gulgasxom Subject*. EPA PropCWJl Dtar Amy.

Here are my cornments. ITiese ere based on my perspective as the attorr.ey for the tenants of 125 Cedar St and in particular, on my experienoe of byjng to negoliete an agreement with their landlord under which it would dean their spaces, (wh ch we're actually close to slshing.)

Post-Cleanup Sampling procetiures: Yha bwii ingt e!evatfir(8) snouio ob run Before sampiiAg starts.

Scops of Work A. psra. 1.; Who other than an occupant '•.uuld be an "authonaed perjon?' in addition, an occupant present during cleaning must be given appropriate personal protective equipment and respirator. para. 4: Th* aurfaces to oa cleaned should also includ* the interior of all furniture ano apptianeas.

Scope of Work B. para. 11. The comparable paragraph in Scope of Work A provides for the cleaning of appliances and ecu^ment; Scope of Work B does not so provide; H Is tmponanl that appliances be e'eaned: or, if they Bennet os, they should be removed and replaced bv a government agency or charity. The comparable paragraph of Scope of Work A also provides for the cleaning o* persona! property such as papers; Scope of Work B does not address this.

This paragraph should also provide that both the aalarier arte interior effumiture ba eieaned • for exempla. cupboards, bureaus, file cabinets, ate. This paragraph would permit a building ewnsr to approve of the disposal of property without the approval of the unit occupant however, only tne unit occupant should be able to approve me disposal. This (hen requiras ih( unit occupant be present (as is appropriate, to protect the safety of personal property); conseouently, the unit occupant must be provided with appropriate personal proactive epuipment and respitator.

It may also be rweessary for personal properly to be stored while the cleaning 1s going forward: In that event. the EPA Should arrange for me moving and ctorapt of these items.

General Comments: The Scope of Work should provide that the exterior of each building, induding light oourts and air ehsfte, be thoroughly cleaned before the eommencement of interior deanbg. At 125 Cedar, for example. Hems such as sir eondiiierters are at the bottom of the air shafts. These must be removed, end the air ehaft itself thoroughly eieaned. Fost-abetement testing should a.se ee dox* for mold, which is a serious problem m buildings which have remained unoccupied sinee September 11. and appropriate cleaning procedures must be used to remove mold.
