3.10 COASTAL ZONE MANAGEMENT

The Federal Coastal Zone Management Act (CZMA) of 1972, established to support and protect the distinctive character of the waterfront, set forth standard policies for reviewing proposed developed projects along coastlines. New York State Department of State (NYSDOS) administers the program at the state level and the New York City Department of Planning (NYCDCP) administers it in New York City. The program includes 44 statewide policies for waterfront protection and improvement and 12 policies specifically for New York City.

The purpose of the CZMA. is to encourage and assist the states in preparing and implementing managemexit programs to “preserve, protect, develop, and where possible, to restore or enhance the resources of the coastal zone. The New York City WRP is authorized under the state’s Coastal Zone Management Program that stems from this Act The WRP is the city’s principal coastal zone management tool. It establishes the City’s policies for development ai d use of the waterfront and provides the framework for evaluating the consistency of all discretionary actions in the coastal zone. The Np” York State DEC is responsible for management and protection of natural resources and environmental quality. The DEC regulates activities that may have a negative impact on wetlands and water quality. Activities such as draining, filling, or building structures within a wetland or its adjacent buffer area may be undertaken only if DEC has issued a permit. The US ACE is responsible for the protection and management of the waterways and wetlands. The USAGE issues and reviews permit applications for activities occurring in navigable waters and in tidal or freshwater wetlands that meet the national
