INSPECTION DISCLOSED: This inspection was conducted based on a complaint received by the Department. The following is the chronology of events for the above mentioned site: * The complaint was received at 10:03am and I was paged to respond to the site.

* I arrived at the site 11:30am. In the 7th floor apartmentsP!!.; I met P I I ;the occupant and her attorney Joel Kupferman of New York Environmental Law & Justice Project. I oberved Robert Fitzpatrick, The Regional Asbestos Coordinator, Enforcement Officer of USEPA coming down from the roof through the skylight ladder.

* The EPA Officer stated that he observed some charcoal like material appeared to be fresh at several spots on the roof and collected bulk samples. I entered through the skylight, wore my disposable coverall and entered on to the roof. Mr. Kupferman also came on to the roof and showed me the charcoal material where the EPA Officer had collected samples. I observed charcoal like material at the northwest side and near the west side drain near the west wall mixed with dust and did not appeared to be WTC debris. The materal appeared to be recently placed on the roof. The roof was painted with silver paint. There was no ongoing construction observed. The east side parapit wall appeared to be newly cemented. After the roof inspection I removed my coverall and placed it in to a bag and bagged in to my bag.

* After my inspection Mr. Kupferman stated that the material was tested on the roof and was more than 1% for asbestos._._._._._Pi!._._._._.istated that there is construction at the stairwell behind her apartment and showed me the work. She also stated that the workers are going to cut the roof in order to construct a new bulk head and the roof was previously tested and contains asbestos. I observed three individuals breaking the sheet rock wall to install new ones. There was no suspect ACM observed. The workers were advised not to cut the roofr_.T_hiworkers claimed they were not there to work on the roof and only going to work in stairwell. At this point I._._.__P 1..._._._. ;wanted me and the EPA Officer to stop the construction work in the stairwell. We informed her that there was no suspect ACM observed in the stairwell, therefore we have no authority to stop the sheetrock removal work.At.this point the EPA Officer raised concerns that the charcoal material appeared to got to the roof recently and L P I I _ I got offended and said that she observed the material since July of 2001.

* Now Mr. Kupferman claimed that the third floor elevator shaft window ledge contains deposit of dust and TEM anlysis results showed more 1% of asbestos. He further claimed that there was a daycare center operates in the 3rd floor apartment and we shall collect samples of the dust on the window ledge. An inspection of the 3rd floor elevator shaft window ledge revealed deposit of old dust. The dust appeared to be very old and did not appeared to be WTC debris. The window was broken and partially torn plastic was on the window. The elevator appeared to be a freight elevator and old dust was observed on the safety grills. After a discussion myself and The EPA Officer decided to collect bulk samples from the 3rd floor window ledge in the elevator shaft.The EPA Officer collected several samples and I collected one of my sample and a split sample from the dust on the window ledge. Further inspection of other windows revealed similar conditions of 3rd floor window -f-then collected the building contact information (the building is co-op and a board president was incharge, who does not reside in the building) and about to transport the samples ( one DEP sample from the window ledge and three split samples from the EPA Officer) to Lefrak laboratory.
