This inspection was the continued monitoring of the DEP clean-up activities at the site. All work to be performed In accordance with contracts WTC-LBC and WTC-LBA. Clarifications and updates were provided to the contractors and residents by e-mail. Copies of correspondence to be incorporated with these Inspection reports.

The JLC Project Monitor was Mr. Michael Atteberry. Mr. Atteberry indicated that he had entered the work area prior to my visit to the site, but that he was not aware of the specifics of the project. I inquired as to whether he had read the scope of work and he stated that he had not. I informed him that I would provide an overview during my walk through but that he should familiarize himself with the scope of work provisions. The site supervisor was Mr. Peter Tomczyk (Certificate # 84306). Mr. Tomczyk Indicated that the shift was to bag out waste and perform some gross cleaning of the areas. Workers were on the 2 nd and 3'd floors.

The inspection disclosed that the demolition activities of walls and ceilings were nearly complete above the 3`d floor. Some Isolation barriers required reattachment. Waste bags blocked the exit from the elevators onto the floors at multiple floors. The bags were piled over six feet high. This practice is unacceptable and had been indicated as a concern by Mr. Lutchmedial during a previous Department inspection. During an update on 3/14/03 from Mr. Lutchmedial, he stated he had addressed the matter with the site supervisor. These were different bags (bagout had occurred since Mr. Lutchmediai's inspection and new trailers were brought in. The practice of storing the waste immediately in front of the elevators must stop.

Access to the third floor from the elevators was completely blocked. Bags were present in the elevators. We accessed the third floor by returning to the fifth floor and taking the stairs. The stairs at the 3'd floor were also blocked but not as completely as the elevators and we were able to climb over the pile (3 to 4 feet high). Upon getting near the apartment on the third floor smoke was visible and the odor was sensible through the respirator filters. Access to the unit was also blocked by bags, but again it was possible to climb over the pile. I observed three workers, one worker had a bucket of water and they were putting out a small fire on the polyethylene. The GFCI had tripped and the area was rather dark. It seemed a temporary lighting chord had fallen and one of the light bulbs broke sparking and starting the fire. A one square foot of polyethylene and duct tape was damaged. House power was on in the podiatrist office.

Bagout was in progress by other workers when we reached the equipment/wash room. The catch basin was not in place and workers rolled the waste passed me to the next room while still in the same PPE. I shouted for them to stop and the project monitor chased them through. A warning regarding proper waste handling was issued. The waste labels did not indicate the NYCDEP as owner. Corrective action required.

Serious conditions noted during the inspection. All work to stop until all waste is properly removed and electrical situation is corrected. All temporary power to be shut down at the GFCI, except for the dedicated power to the negative air machines.

I spoke to Mr. Bob Middleton of ETS, Mr. Mohammed Khan of JLC, and to Mr. R. Radhakrishnan regarding the conditions, the corrective actions and progress of work. 2
