would have traveled to the Yonkers WWTP. Instead the water was discharged to the basement of Shaft 18, where sump pumps pumped the water to an unnamed tributary leading to the Bronx River. DEC is expected to exact a $ 25,000 penalty for this discharge. There were no discernable effects on the water quality of the Bronx River as a result.

Ultraviolet Light Patent DEP was advised that the Calgon Corporation has been granted a patent for the use of UV to inactivate Cryptosporidium. The patent applies to all users of UV who practice continuous dose UV and low dose UV. At the expected rights fee of 10 per 1000 gallons treated, it appears that we will be obliged to pay Calgon about $4 million/yr once our proposed UV plant begins treatment. It is understood that AWWA, EPA and others are looking into this matter in the hope of overturning the patent.

Westchester County Airport/Kensico Reservoir Engineering staff has received notification from Westchester County that, based upon comments it received concerning the Draft Supplemental Environmental Assessment and Supplemental Environmental Impact Statementfor the Proposed Water Quality Buffer and the Reuse of the Former Air National Guard Site, it has completed a Final Scoping Document. The proposed actions to be taken at the Westchester Airport include the creation of an undisturbed forested buffer between a portion of the airport and the Kensico Reservoir, new measures to improve aircraft deicing practices at the airport and several options for the use of the portion of the airport formerly used by the Air National Guard. DEP submitted extensive comments to the County concerning potential impacts on the Kensico Reservoir anticipated from the proposal and will review the final version to ensure all issues have been satisfactorily addressed

House-to-House Septic Survey/Kensico Reservoir. DEP has received numerous responses to the Kensico House-to-House Septic Survey questionnaire, which was sent with a letter soliciting support for DEP's survey by the Town of North Castle Supervisor. Similar letters, with the questionnaire, are being sent by the Supervisor of Mount Pleasant, while the New Castle Supervisor has agreed to send a letter to municipal residents with septic systems asking for them to support DEP's program. Only the Town of Harrison, where relatively few septic systems exist, declined to participate in the program. The house-to-house survey is being conducted to identify failing septic systems in the Kensico Watershed pursuant to the Filtration Avoidance Determination.

Gowanus Flushing Tunnel Returned to Service The Gowanus Flushing Tunnel (GFT) has been returned to service and is now fully operational. The GFT was shutdown from November 13 to December 1 for repairs and equipment replacement. The short duration of the shutdown was achieved by the coordinating efforts by Agency staff. Along with the contractor's replacement of worn components, machinists fabricated special parts, Marine Section specialists examined the Tunnel's propeller, underwater divers greased gate stems, and metallurgists investigated the causes of stem deterioration. Crews also cleaned out sediment and debris at the Buttermilk tunnel entrance prior to the restart.
