In no event shall the Project be sized to handle flows from any new hook ups after the date hereof at either such area. * No additional connections may be made to the Project without the City’s written consent. The City will consent to the connection of any of the following areas, currently served by failing or soon-to-be failing septic systems, subject to the limitations noted below: [Identify areas and estimated aggregate flow] Limitations a) The City will not be responsible for any costs associated with connecting such areas to the Project, including, without limitation, any costs for uparades or improvements to the Peekskill or Yonkers Joint WWIPs to handle flows from such areas, nor for any incremental operational and maintenance costs related to Project facilities or to such WWTPs. b) Flows to be handled from such areas are limited to current flows from existing occupied structures in such areas, connected to operating septic systems as of the date hereof: flows to be handled shall not include any flows from new development. * 10% diversion "credit" earned available under Watershed Rules and Regulations, after completion of Project, to be limited to accommodating needs of County for school expansion/construction and/or construction of affordable housing, @5 per in accordance with and limited by the [reference court decree/plan or other relevant document(s) spelling out plans for affordable housing construction]. County to enact local legislation to effect this limitation. 4 - Desien, Construction, Project Timetable: * County to bid out, contract for, and manage design and construction of Project. * County to complete Project within 36 months of date of execution of intermunicipal Apreement (see below): County to make diligent application for_all necessary permits upon commencement of Agreement and while design work is underway; first priority shal! be given for the permitting and design of Project facilities necessary to divert the Yorktown Heights WWTP.
