Hoffer General Counsel As I promised in our recent conversation, I am writing to enlist Bureau of Legal Affairs your assistance in coordinating and facilitating the City's participation Tel (718) 595-6555 in the One Call Users' Council, Inc. ("One Call"). Article 36 of the New Fax (718) 595-6543 York State General Business Law and 16 NYCRR Part 753 require www.ci.nyc.ny.us/rlep Operators of underground facilities within the State of New York to participate in and be responsible for administration of a One Call notification system to receive and disseminate information concerning proposed excavations and to designate their underground facilities by staking and marking when notified of proposed excavation work.
Over the past months, Commissioner Joel A. Miele, Sr., P.E. has received correspondence from both the State Department of Public Service and One Call reminding DEP of the statutory requirements and soliciting the City's participation in the One Call system currently operating in this area. Commissioner Miele has acknowledged the important public safety aspects of participation in the One Call System and has directed DEP staff to do what is necessary to ensure our participation at the earliest possible date.
We have been in contact with One Call and have been informed that City of New York as a municipality would by statute be exempt from paying a proportionate share of the cost of operating the One Call system. This membership however, would entitle the City to receive the One Call notifications (which would enable the marking out of City facilities) at only one location which we would designate. a+a,r oeanar If the City determined that it required additional notifications (i.e. to more than one agency) it would have to pay a full charge for each.
