Wbilo stair was cngagod in preparing tho Agoauy'a response domonatrntin5 that almost all of the oitationa were inaceurnte, previously approved procedures Qt n0 1VA$oc cxlottns pxVblema, wo wvro upset and disappointed to receive an USEPA Order of July 14* containing notices of violations, under the general heading of failure to fulfill the conditions of our industrial pretreatment permit. Certain violations were to be corrected immediately, and the remainder requiring compliance within 90 days, This was completely unexpected and essentially subverted our anticipated response to the Audit Report, A letter has been sent to the Region 2 office, requesting a meeting to discuss this matter further and, hopefully, to arrange the withdraw of the order.

Expansion of the Consolidated Edison Steam Plant at East 10 Street and Avenue C; Manhattan Representatives from several DEP Bureaus, Consolidated Edison (Con Ed), NYC Economic Development Corporation (EDC), and their consultant have held several meetings and discussions related to the design plans for Phase I of the Steam Plant expansion in the area of Stuyvesant Cove (East 14° Street and FDR Drive). Local opposition is emerging to Con Edison's proposal. An umbrella organiation, East River Environmental Coalition (ERIC) is holding a community meeting on August.21st with federal, state and local officials. DEP has formally requested that the NYC Economic Development Corporation (EDC), and their consultant engineer, act as DEP's agent to provide watermain improvements within the scope of EDC's current capital contract for the Stuyvesant Cove Area. This contract, which covers Avenue C between East 18th and East 23rd Streets, includes part of the Con Edison Steam Plant expansion. Under the Stuyvesant Cove work, now 24" water mains will be constructed in Avenue C from East l8th to East 23rd Streets. Existing catch basin chutes under the FDR Drive will be raised. Additionally, existing sewers within the project limits are now being reviewed by DEP for possible work. Con Edison has agreed to provide • the necessary funds for the water main design cost, test pits, and the videotape costs. DEP shall provide finding for water main construction and resident engineering costs. This work shall be performed by EDC and their contractor as a change order to the work presently underway. In meetings and discussions, it was further agreed that a second capital contract will be ordered by NYC EDC which will include Phase 1I of the water main and sewer work. The scope of work for this project is still being developed by DEP, but will include the construction of new 24" water grains in East 20th Street, Avenue C, East 15th Street, and south of East 14th Street in Avenue C, As part of the Article X permitting process, the Department has submitted comments to the New York State Public Service Commission regarding the completeness of Con Edison's Application for Certification of a Major Generating Facility, We have requested that the analyses be supplemented with a cumulative air quality impact study. This type of study focusses on the combined effect of proposed and existing large facilities in the immediate neighborhood surrounding a site. It is not necessarily required by the State but is routinely requested as part of our air permitting process for facilities with the potential to have significant emissions. To date, Con Edison appears willing to comply. We have also requested an analysis of potential odors emitted by the project, a construction related noise analysis and more information with regard to their potential hazardous materials site investigation.
