Fire Insurance Liens DEP has initiated a pilot program, in conjunction with the Department of Finance, to secure payment from fire insurance proceeds where there are open water/sewer charges on the properties that experienced fire damage or destruction. According to Section 22 of the NYC General Municipal Law and Section 331 of the NYS Insurance Law, outstanding special liens, such as water and sewer charges, are collectible against the proceeds of fire insurance policies. However, the lien holder must serve the insurance company within 20 days of the notification of the loss. In order to take advantage of the potential revenue stream, DOF has agreed to notify DEP immediately when a notice of claim is received by DOF at their offices. DOF will also access the DEP water/sewer billing computer system to determine ifthere are outstanding charges and simultaneously DEP will review the charges to ensure that they are accurate and valid. Where necessary, the account will be reconciled so that the claims can be made without challenges. As part of the agreement with DOF, any revenues collected for watertsewer charges will be paid to DEP and the account will be credited with the payment. We are projecting a collection of $5 million per year, utilizing one staff person.

USEPA Pretreatment Program Order containing results of the On June 26°i, the USEPA Region 2 office issued its Official Audit Report, NYCDEP Pret eat rent Program Audit it had conducted earlier in the year. This audit is a comprehensive investigation of the Agency's industrial pretreatment activities, thus there is adherence to expectation that federal auditors will be able to cite an occasional failure of strict federal regulations. In this instance we were surprised to receive an extensive list of citations, within specified time claiming violations of reporting procedures, not issuing pretreatment permits into homes, and many more. The Audit Report provides a comment period, in this case extending September, to respond to the citations, whether disagreeing, complying with remedies, or suggesting alternative actions.
