RE: Disclosure of Confidential Statements of Formula

Based on our discussion, RISE proposes the following solution to allow the timely completion of a risk assessment of the 20-adulticide mosquito control pesticides:

1, A risk assessment will be conducted for all 20 insecticides on the New York City list. The risk assessment will be available for communities statewide.

2, On behalf of adulticide mosquito pesticides, RISE will support execution of a memorandum of understanding (MOU) between New York City Dept. of Health and DEC. The MOU will authorize DEC to provide confidential statements of formula, for adulticide mosquito pesticides, under a strict confidentiality agreement to the NYC contractor. DEC will have the ultimate responsibility to hold the contractor responsible for maintaining the confidentiality of any materials supplied.

3. The MOU between New York City DOH and DEC will provide that the role of DEC is to release data for adulticide mosquito pesticides to the New York City contractor while maintaining strict confidentiality of all materials.

4. NYC will not receive any confidential business information (CBI) information but the specified contractor will have access to the CBI through DEC.

5. Registrants will not disclose any CBI information to NYC.

6. DEC will maintain confidentially of the CBI data

7. Registrants will be afforded an opportunity t0 provide technical corrections prior to completion of the risk assessment.

RISE believes this solution will afford New York City DOH the opportunity to complete the risk assessment while maintaining the confidentially of registrant data.
