FEB-22-2001 12:10 MAYOR'S OFC of ENV. COORD 1 212 788 2941 P.04/10

HPD Projects. MOEC met with HPD, DOT and DEP on February 21, 2001 to discuss CEQR review of various HPD projects in Harlem and in Arverne.

EPA Brownfields Grant: EPA has officially approved our request for an extension of the grant until July 14, 2001. We need D/M Lhota to countersign the approval letters, which we will return to EPA. The approval endorses our plan to streamline the tracking of the budget and progress of the tasks.

MOEC initiated discussions with KeySpaa about the MOU and Voluntary Cleanup Agreement for Carroll Gardens. MOEC received comments on the draft MOU from DCAS today. We have now received comments from all the relevant agencies and will revise the MOU and submit it to KeySpan. MOEC will also contact DEC informally regarding KeySpan's Voluntary Cleanup Program application. As MOEC continues to receive calls from Assemblywoman Millman's Office, we will schedule a meeting with her once we have touched base with DEC and met with KeySpan. DOS, with guidance from DDC, began to clear non-contaminated surface debris, such as abandoned vehicles, scrap metal, and surface concrete, from the vacant portion of the site. During this operation, DOS' equipment punctured one of the drums on the site, which appears to have spilled a small amount of an oily water mix onto the ground. Pursuant to protocol, ADC is contacting DEC for a spill number and is collecting a sample of the material.

MOEC is setting up a meeting with DPR and the Army Corps to discuss mapping of Vernam Barbadoes Peninsula. For your information, the City has an old, outstanding Army Corps violation on part of this site, The Army Corp. continues to call Parks about this violation. If possible, in conjunction with the Law Departrnent, we will try to resolve this matter as part of the whole project. However, the work that will need to be done to resolve the violation is very costly.

A conference call was held among DEC, State DOH, EDC, DEP, MOEC and the consultant to discuss the draft Site Investigation report on Barretto Point. DEC thinks the report is close to being finalized and expects to send comments next week. DEP plans to apply for remediation funding through the Brownfields Program of the Clean Water/Clean Air Bond Act once the State issues a record of decision (ROD), probably in early fall. MOEC is working with DEP to plan the next meeting with community leaders and elected officials regarding this site.

Regarding Bushwick Housing, a draft Site Investigation Report for Site I is expected to be ready at the end of the month, and HPD is awaiting test results from site 2. MOEC will meet with HPD regarding spending the $5,000 allocated from the EPA brownfields grant.

NYS Bond Act Brownfield Projects. EDC has obtained a temporary lot number for the underwater portion of the land at the Bush terminal site. This will enable DBS to complete the State Assistance Contract for the upland portion and send it to DEC. The Bond Act does not permit the State to indemnify underwater land.
