Deputy Mayor Joseph Lhota Deputy Mayor for Operations Office of the Mayor City Hall New York, New York 10007
Dear Mr. Lhota:
I appreciate your help in finding the assignment as Project Manager of the CEQR Technical Manual in the Mayor's Office of Environmental Coordination. I am enthused about working on this mayoral priority project.
Prior to my accepting this assignment, DEP had been working for some time on my promotional paperwork as Chief of Environmental Compliance. I had been doing SPDES and environmental compliance work for over two years without the promotional salary.
A brief chronology of events is shown below.
In June 1998 the position of Chief of Environmental Compliance was posted (Attachment 1). was told I had the promotion in July 1998 and was promoted to Chief of SPDES Compliance (Attachment 2).
The Bureau prepared the paperwork for an M-11 position, salary of $66,250 (Attachment 3). I was subsequently told the paperwork had been pulled back, "there were too many in the pipeline to OMB". I assumed the additional SPDES compliance responsibilities of the promotional position without the promotional salary.
Later that year I was asked to assume additional RCRA environmental compliance responsibility including hazardous waste reporting for the 14 plants and over 100 pumping stations. I did this.
A New Needs request for fy2000 was prepared for my position, Chief of SPDES Compliance at $70,000 to be sent to OMB. (Attachment 4). It was sent back. A New Needs request for fy2000 was also prepared for Chief of Environmental Compliance for $65,000. That was sent to OMB and apparently approved. (Attachment 5).
I was asked to take on additional environmental compliance responsibilities noted in Attachment 4 and I did. I told DEP I was happy to take on the additional work, however I wanted to be compensated commensurate with the level of responsibility. I was told "it was an engineering Bureau, the engineers would get upset if I received the promotional salary."
