1. Five resident updates from RMC 2. ASTM test method 5755-95 3. Memo from Ed Olmsted, CIH, CSP dated December 9, which is addressed to Joel Kupferman. Mr. Olmsted performed the single dust sample ASTM test and provided the results to Mr. Kupferman of NYELJP. Mr. Olmsted's memo clearly indicates that "There is no suggestion in the ASTM method that it can be used to assess general health risk from asbestos exposure, nor does it suggest that all building surfaces be maintained to the levels published in the standard". He also indicates that "The duct system should be cleaned by a professional duct cleaning company using vacuum and cleaning equipment designed for asbestos decontamination." We had already contracted to have the ducts cleaned using exactly those methods when the test was taken. 4. Formal notification of complaint dated December 11th, filed with your office by the NYELJP under the signature of Joel Kupferman and copied to numerous local state and federal agencies and elected officials. The complaint alleges a "high level of asbestos contamination at 105 Duane Street. 5. Summary of Ambient Air Sampling to Date memo from ATC Associates Inc, our environmental consultant, dated December 11, 2001 and distributed to every resident in the building today December 13, 2001. Bottom line on asbestos, 209 samples taken to date using TEM over a period of months in apartments and common areas an NO ASBESTOS found in 207 samples and 1 structure in the other 2 samples. Also no indoor air quality issues at all based on testing for fiberglass, pcb, CO, CO2, volatile organic compounds, respirable particles, copper, lead and chromium. 6. Web site of NYELJP dated today which indicates "EMERGENCY!!! DEC. 11: Residents of 105 Duane Street (TRIBECA TOWER) — Your building has come up with a high level of asbestos contamination. Industrial Hygenist Report!! And Our letter To Various City, State, and Federal Agencies Who Are Coming to the Building on Wednesday December 12th in the Morning (DEP HAXMAT Team & Department of Health" 7. Memo from ATC dated December 13th confirming the clean results from the TEM tests that were performed last evening at the request of and supervised by a DEP representative.
