Additionally, on December 12, 2001, ATC collected a total of ten ambient air samples, five from within the 10 th floor common hallway and five within the 2 floor mechanical room to ascertain ,

the presence or absence of airborne asbestos. The samples were collected at the request of the New York City Department of Environmental Protection (NYCDEP) in response to a tenant complaint regarding hallway duct cleaning operations. Samples were analyzed in accordance with the more stringent AHERA Transmission Electron Microscopy (TEM) method as set forth at 40 CFR Part 763, Subpart E, Appendix A. Both the 10th floor hallway and 21 floor mechanical room exhibited analytical results of no asbestos structures detected, which is below the AHERA clearance requirement. It is ATC's opinion that duct-cleaning activities did not result in elevated asbestos levels within those spaces, and the ambient conditions sampled at the time of testing meet an acceptable criterion for occupancy. On December 27, 28 & 29, 2001, during duct cleaning activities ATC collected a total of fourteen ambient air samples, ten from within common hallways and four within the 2nd floor mechanical room to ascertain the presence or absence of airborne asbestos. The sample methodology, quantity, and location were agreed upon between Related Management, ATC and H.A. Bader Consultants Inc. the tenants associations consultant. Samples were analyzed in I accordance with the more stringent AHERA Transmission Electron Microscopy (TEM) method as set forth at 40 CFR Part 763, Subpart E, Appendix A. •' Based upon the analytical results from the 2"d, 50", 10th, 15th, 20th 25th, 27th, 34th, 41St floor hallways and 2"d floor mechanical room of no asbestos structures detected, which is below the AHERA clearance requirement. It is ATC's opinion that duct-cleaning activities did not result in elevated asbestos levels within those spaces, and the ambient conditions sampled are representative of the building at the time of testing and meet an acceptable criterion for occupancy.
