GENERAL EXCEPTION" RE; ALL WORK REQUIRING STREET EXCAVATIONS.

Due to the possibility of underground utilities, existing water mains, pipe lines, fiber optic cables, telephone lines, relocation & replacement of existing gas mains, conduit ducts, rock excavation, dewatering removal of existing soil determined ” NOT SUITABLE FOR BACKFILL" by the NYCDOT or NYCDEP and furnishing suitable soil, contaminated soil removal & disposal, etc., we hereby take exception to and accept absolutely no responsibility for the cost of relocating these utilitie; and performing any additional work in order to perform the installation required by our contract. We will however, cooperate in every way with the governing utility to negotiate an amicable means for the; utilities to be relocated by their forces, or by our forces subsequent to an agreed change order in writing prior to beginning any additional work.

Dewatering and rock excavation if required is not included in this proposal and if required will be performed by our forces and paid for on a time and materials basis or another method acceptable to both parties.

In the event a change order is required and can not be negotiated at the time it is discovered and we art required to close up any excavations, there will be an additional charge for remobilization of our forces when an agreed change order has been signed both parties.Please be aware the job will not continue until the additional work authorization is signed.
