ASBESTOS CONTROL PROGRAM (ACP)
Purpose
To protect public, workers and the environment by ensuring controlled
abatement of asbestos containing materials.
Authority
Title 15, Chapter 1 of RCNY (Local Law 76 of 1985)
Delegation of NYC DOL ICR 56 (Local Law 101 of 1989)
Delegation of US EPA NESHAPS - 40 CFR Part 61
Functional Units
Technical Review unit, Enforcement & Training and Certification Unit.

Process asbestos notification forms
Process variance applications - Develop and approve procedures
that protect public health and the environment where compliance
would be a hardship.
Revenue for FY2001 - $2.5 million
Staff - Tech. 6, Non-tech. 4 & Temp. 2
Enforcement Unit
Response to complaints 24 hours per day, seven days a week.
Conduct unscheduled inspections based on the asbestos
notification.
Issue Notice of Violations (NOV) and provide expert testimony.
Assist and cooperate with other Enforcement agencies like FBI,
US EPA Criminal Investigation Division, Attorney General’s
Office, District Attorney’s Office, US DOL OSHA, NYS DEC,
Inspector General’s Office and provide expert testimony based on
our investigation.
Audit NYC DEP certified investigators and Not An Asbestos
Notifications.
Illegal dumpsite clean-up using Asbestos contractors where
responsible party in not identifiable.
Imposed fines $2.7 million for calendar year 2001
