Talking Points WTC Hot Issues Call 7/11/02

We have completed the scopes of work for the cleaning and testing of residential areas in lower Manhattan. These will be the basis for the award of contracts and subsequent program start up.

These scopes have been developed with input from not only NYC DEP but from various community groups and elected officials. No further revisions to these scopes are planned.

Although we have had significant input as previously mentioned from various interested parties we have will not be able to address all their concerns, thus we believe that the release of the scopes, through the conu'act bid process will be very controversial.

We are raising this as a “heads up” at this point. Jane will arrange to brief in detail on this. Some areas that we have not been able to achieve consensus on are: ► EPA’s allowing participation in the program to be voluntary rather than mandatory (through an opt out program), many would like EPA to use NCP authority to force clean up Scope of contaminant sampling should be broadened for both pre- and post­ sampling efforts ► Use of 10"^ risk level, which is consistent with the Libby, MT approach, for asbestos instead of 10*® risk level ► Legal requirements for cleanups, NYS attorney general has opined that the NYC asbestos regulations are applicable to these cleanups, we don’t agree. Also, the AG wants every apartments tested for lead regardless of whether lead is an issue arising from the collapse of the WTC or a pre-existing condition. HVAC systems - In lieu of testing all HVAC systems, we will be dealing with these on a case-by-case basis Citizens Advisory Committee - we remain committed to meeting with all interested parties, however, we don’t believe that a CAC would help to expedite clean-up

As mentioned earlier, Jane and Kathy Callahan will be briefing you on this in the very near future as this program is essentially ready to go to contract and further delays need Io be avoided.
