SUBJECT: New York Power Authority In-City Generation Project

Dear Commissioner Gilsenan:

I am responding to your January 12; 2001 letter, in which you request the New York Power Authority (NYPA) to apply for permits under the New York City Air Pollution Control Code, Section 24-101 et seq. of the New York City Administrative Code, for its natural gas twbine generators being installed as part.of NYPA's In-City Generation Project. Because NYPA is a political subdivision of New York State, it is not subject to such local permitting requirements in carrying out its goventmental functions — in this case assuring adequate electric power in New York City in order to avoid the kind of power shortages currently being experienced in California.

Nonetheless, I wish to assure you that the 10 natural gas turbines to be installed at six sites in New York City as part of NYPA's In-City Generation Project will meet or exceed all New York City environmental standards. NYPA has committed to installing state-of-the-art environmental controls and to burning natural gas in each turbine. The emissions of nitrogen oxide will not exceed 2.5 parts per million (far less than the Code's emission limit for combustion units of 100 ppm), and particulate and sulfur dioxide emissions will also be far below the Code's performance standards.

On January 12, 2001, the New York State Department of Enviromnental Conservation issued final permits for five of the six In-City sites. These permits include specific limitations for nitrogen oxides and carbon monoxide and specify that each turbine shall use only natural gas
