JRN-31-2001 18!31 MAYOR'S OFC of ENV. COORD 1 212 788 2941 P.04/07

The draft Site Investigation report on Barretto Point is being reviewed by NYS DEC. MOEC is working with DEP to plan the next meeting with community leaders and elected officials regarding this site,

EPA Brownfields Roundtable for NYS Pilot Cities. This meeting is scheduled for February 8. MOEC is helping to develop the agenda for the meeting, which will focus on brownfields financing. Staff from EDC are likely to attend as well.

GIS. Lee Ilan and Daniel Avery will meet with the MIS unit to determine what is necessary to install the upgraded software and to connect the GIS to a secure server and printer.

Superfund Legislation. MOEC sent a memo soliciting agency responses to the various proposed Superfund bills, including the Governor's bill, to DEP, the Law Department and DCP. We will set up a follow-up meeting as part of our ongoing effort to coordinate the City's response to Superfund reauthorization,

Energy Projects. Although MOEC is neither the lead nor the project manager for any of the energy projects, we will update you on. any information we are aware of with regard to these matters.

NYPA Turbine Generators: As I mentioned last week, DEC issued NYPA air permits for six of its facilities. DEP sent NYPA a letter indicating that NYPA must obtain air permits from DEP. In response, NYPA recently sent the attached correspondence to DEP. (As soon as we get a legible copy, [will send it to you.) The bottom line is that NYPA determined that they do not need to obtain air permits from DEP. DEP neither agrees nor believes that NYPA has set forth a good reason for their decision, and awaits direction on how to proceed. I will forward the letter to DIM Harding's Office. The big picture for DEP is that if NYPA does not apply for these local air permits a bad precedent is set for future projects.

FYI — with regard to the Long Island City site, the community interest groups are expected to sue NYPA by the end of this week or beginning of the next.

PSC/Request for Waivers: As I mentioned last week, several months ago, Astoria Energy, LLC requested certain waivers of City regulations and permit requirements in its Article X application. This week, Astoria withdrew most of their previous requests. However, some issues remain outstanding. Rich Miller has scheduled a meeting for February 14th at EDC with PSC and others to discuss this matter.

Coney Island / KeySpan Site. Due to the numerous environmental issues surrounding this property, MOEC has been working with the other agencies on this potential acquisition. Over the past several weeks, MOEC contacted KeySpan to put them in touch with DEP to discuss various testing issues and protocols. To date, KeySpan has not contacted DEP. Most likely, the KeySpan environmental personnel were waiting until Keyspan had formally responded to the City's original letter of intent. The City recently
