Legal - (Next meeting 10 am, 3 April, 100 Gold St, 5th floor conference room). EPA raised some concerns about the Federal Privacy Act and how it may apply to some of the data we have. Lai-Sun Yee will discuss this with Region 2 counsel, which will funnel any concerns of EPA HQ to the legal group. Sylvia Pryce noted that DCAS has shared its data with the unions. Steven Levi from the Torts Division of the Law Dept, urged everyone to maintain and secure their files and document all efforts being done around Lower Manhattan environmental issues, as there will be lawsuits in the near and far future.

WTC Worksite - Bob Adams noted that the number of loads and tonnage taken from the site to the pier has dropped significantly, to approx. 130 loads/24 hours, from about 650 at peak. This is good news and should be touted - Bob will write up the numbers and forward to OEM. West Street will re-open on 29 March. Once the steel from building six is removed in 2-3 weeks, it may no longer be cost-efficient to keep the barge operation going. They are looking at other options. Bob will keep us updated.

Diesel Emission Reduction - Diesel generators continue to be removed, as the site is largely on the Con Ed power grid now. NYS DEC is working to set up a meeting with Tully, the largest subcontractor on site, to promote their participation in a pilot project. Bovis (the prime contractor) is interested, but no word from Tully as yet. Chris Zeppie reported that the Port Authority is discussing the pilot with NESCAUM and with Yonkers Construction, which leases equipment to Tully.

Charting Task Force Progress - Jim Miller suggested the task force begin tracking a number of potential objective indicators of its success in addressing environmental concerns downtown: school enrollment (Board of Ed) residential vacancy rate (?) commercial vacancy rate (EDC) real estate property values (residential and commercial) (?) food service permits (Health?) property sales (DOF) employment (DCP) Lee Ilan will reach out to Board of Ed, Finance, and discuss what info may be available with D/M DoctorofTs Office. Barry Dinerstein will check what info DCP has available

EPA Efforts - Indoor Air Task Force and Work Group (lATF/IAWG) (Work group meets every Thursday at 10 am at 290 Broadway. Contact Dore LaPosta [email protected]) EPA issued a press release re air quality actions on 25 March, and Rep. Nadler issued another press release criticizing EPA. Copies of both were e-mailed to the entire task force.

Contaminants of Concern - This group, which is also looking at issues of benchmarks and cleaning, has regular 2pm Monday conference calls. For info contact Mark Maddaloni at maddaloni [email protected])

FEMA request -Ed Gabriel reported that the Task Force’s initial funding request to FEMA has been submitted.
