NYC 9/11 Public Portal Document

GIBSON, DUNN & CRUTCHER LLP Joel A. Miele, Sr., P.E. September 14, 2000 Page 2

personally received timely notice, he would have challenged those water bills as excessive. Indeed, from his own past experiences in the textile business, and common experience with water billing problems in the late 1980s and early 1990s, it seems fair to say that such a challenge would have warranted serious consideration. In any event, he now faces not only those huge bill but also enormous interest and penalty charges. Surely, under these circumstances, there must be some room for relief.

I understand that Mr. Rubashkin recently made a personal attempt to raise these issues with other DEP administrators and that his appeal was rejected as untimely. In fairness, however, I urge you to review this unique situation and show some flexibility and mercy to an elder who wants to do right by the City but is being unduly punished for the sins of a relative. Surely, it would be in the City's interest to see this abandoned property returned to a productive use that is reflected on the tax rolls. Mr. Rubashkin is not denying all liability or all responsibility. He is simply asking for some legal and equitable consideration and accommodation.

We stand ready to provide any additional information necessary to resolve this issue and look forward to hearing from you.

Very truly yours,

Randy M. Mastro
