Pending NYS Bills — SuperfundBrownfields

Definition of Key Terms:

Superfund Sites: are sites that pose significant health and/or environmental risks, are addressed by existing state statute and are listed, monitored and enforced by the NYS DEC. In many cases, the State will use money from this program to investigate and remediate problematic sites and subsequently attempt to recoup costs from responsible parties. NYC has spent millions of dollars on two superfund sites: the Penn and Fountain Landfill and Brookfield Landfill and is seeking reimbursement from DEC.

Brownfield Sites: are sites that either have or are perceived to have some level of hazardous wastes on site because of past uses or existing conditions. These are typically not superfund sites. NYC has approximately 5,000 vacant industrial properties, many of which would meet the brownfield definition and would need have some level of site investigation. Unlike many other states, there is no existing state statute to address the investigation and remediation of these sites. DEC has developed the Voluntary Clean- Up Program as an administrative solution to encourage the clean-up of these sites. However, since there are no clear requirements and standards and decisions are made on a case-by-case basis, it is not a widely used program in the state compared to other states.

Petroleum Spills: The Navigation Law regulates the investigation and clean-up of petroleum spills on land and in water. The existing process is designed to facilitate immediate action to prevent the spread of contamination into sensitive resources.
