NYC 9/11 Public Portal Document
Confidential e, and the test results show that existing soil levels are reasonably higher than those suggested (in truth, these guidelines are applied as if they were codified standards) by TAGM 4046, fill can be brought to a site at those higher levels.
In the case of the Ferry Point Park golf course development, the applicant chose to conduct a Site Background analysis. Tests were taken at what were felt to be comparable, representative areas in Central Park, Van Cortlandt Park and other areas of Ferry Point Park. The test data were analyzed and compared with TAGM 4046 and other existing guidelines promulgated by the Federal EPA and others. DEP and the Parks Department and the applicant, after much analysis and discussion, ultimately agreed on a final set of "clean" fill levels th at we felt would be protective of public health.
However, as we reviewed the test data taken from the comparable sites, the levels of arsenic discovered in Central Park, Van Cortlandt and Ferry Point Parks peeked our interest because they were much higher th an we (DEP) expected to find and above existing recommended clean soil objective guidance values. For example, the following are arsenic levels used as guidance by EPA and other states (all values in mg/kg): - USEPA Residential (Ingestion) = 0.4 Residential (Inhalation) = 750 Residential (Risk Based) = 0.43 - New Jersey Residential = 20 - Massachusetts Residential = 30 - Connecticut Residential = 10 - New York = 7.5 or Site Background
The comparable site tests resulted in the following: Van Cortlandt Park - seven tests - 3.94, 1.65, 18.6, 4.51, 6.98, 28.1,
10.7 Central Park - seven tests - 70.9, 6.33, 13.2, 34.8, 6.45, 63.9, & 29. 3 Ferry Point Park - six tests - 7.39, 6.48, 5.96, 3.35, & 5.57
Based on the background analysis, we ultimately agreed with the applicant that the fill material should meet a value of 26 mg/kg for t he
