Alessandra - here is a bit of the history, as you requested. Let me know if you need more.

The Department of Parks and Recreation asked, approximately one year ago, that we act as their technical advisors with respect to hazardous materials, regarding the proposed development of Ferry Point Park into a new golf course. They were concerned because the portion of the park slated for development was used historically as a solid waste landfill under the jurisdiction of the Department of Sanitation (DOS). DOS stopped using the site as a solid waste landfill prior to the adoption of State laws and regulations placing the closure of such sites under the purview of the State Department of Environmental Conservation (DEC

The proposed golf course development team had already hired a consulta nt team to conduct some preliminary site assessment tests. We reviewed t he test data, agreed on a protocol to do further site characterization an d ultimately agreed to a remediation plan that would be implemented at t he site. The remediation plan developed primarily included capping areas of the site where public exposure may occur with "clean" fill. Approximately one (1) million cubic yards (ids) of "clean" fill would be required to implement the remediation plan. A potentially very expensive proposition. Current DEC site remediation guidelines (Technical Assistance Guidance Manual 4046) are often used to define "clean" fill. However the recommended clean soil objectives suggested in that document are recognized as conservative, since they were developed, in theory, to reflect state-wide background levels. It is difficult to find reasonably priced fill proximate to an urban environment that meet the TAGM 4046 guidance levels without some processing (amendment).

An alternate method for defining soil cleanup objectives is allowed under TAGM 4046. One is allowed to attempt to•show that ambient Site Background levels are higher than the TAGM 4046 cleanup levels. Tests are taken at other comparable sites. If the sites are truly comparabl
