Dear Richard,

Thank you for your efforts to deal with our Issues concerning Battery Park City. We appreciate all that you have done and the progress that has been made to date. As much as possible, we have to try to convince the residents that things have returned to normal.

In that regard, a number of critical issues remain:

1) Access We don't understand why there is a continued need for numerous checkpoints throughout Battery Park City. We applaud your decisions to open up lower Manhattan East of Broadway and ask that you do the same for Battery Park City.

(a) Open up Esplanade. This will permit residents to travel north and south within Battery Park City. (b) Unlimited Pedestrian Access Permit visitors and deliveries total access without going through any checkpoints. (c) Vehicle Access Permit cabs, black car services and permit residents to bring their cars in and out of Battery Park City.

2) Air Quality Although all tests by Battery Park City, the City and the owners are negative. DEP and Department of Health flyers and staff have given the perception of danger and have given conflicting directions on how to handle the situation. We need to clarify the procedures and change the message.

3) Procedures for Contractors The procedures continues to change and are overly complex, It we satisfy the access issue, this problem goes away.
