No. 113.22 Finding of Emergency and Determination that Banking Organizations May, at their Discretion, Close Any or All of their Places of Business Affected by the Emergency

• Effective September 21, 2001 (Refer to No. 113.3). Authorized the No. 113.23 Rescinding Executive Order 113.13, which Commissioner of Transportation to Stop Work on Certain Highway Construction Contracts in the City of New York issued. On September 16, 200I, Executive Order No. 113.13 was emergency Executive Order 113.13 is no longer necessary to address conditions in the disaster area in Lower Manhattan. Relating No. 113.24 Temporary Suspension and Modification of Provisions to Access to Proceedings in Surrogate's Court and to Bank Accounts and Money Market Accounts by Certain Individuals as the Result of Terrorist Acts of September 11, 2001

Suspends, until further notice, sections 2401 and 2402 of the Surrogate's Court Procedure Act, so far as those sections require the payment of filing fees in any matter relating to the estates or affairs of persons missing or deceased_

Suspends section 205 of the Surrogate's Court Procedure Act, so far deceased are as it provides that the next of kin of persons missing or required to file Surrogate's Court proceedings in the county of the decedent's domicile at the time of death; and section 205 is modified and altered to allow the next of kin to file in any county of their own choosing.

Suspends Section 902 of the Surrogate's Court Procedure Act, so far as it requires service of process to persons missing or deceased.

Suspends Section 4-104 (e) (1) of the New York Uniform Commercial Code, so far as it relates to customer that was either a

employed in the World Trade Center or the Pentagon, or was in such buildings, or in the immediate vicinity, when the terrorist attacks occurred, or was a crew member or passenger on any of the airline
