2.1 Preliminary Assessment Findings at the Subject Property •

• The collapse of the World Trade Center on September 11, 2001, resulted in the dissipation of dust and debris throughout the Downtown Manhattan area. This debris penetrated a number of the buildings in the • vicinity. At the request of Claris Services Corporation Project Manager for CCMH Fin Center LLC, Hillmann Environmental Group, LLC, visited the New York Financial Center Marriott, located at 85 • West Street in New York, New York, (the "Hotel") to perform an assessment of the dust/ debris intrusion and potential asbestos hazard. The Hotel is located two blocks south of the World Trade Center site. Air samples were taken to assess the airborne asbestos levels and dust/ debris samples were collected to ■ characterize the asbestos content of the debris within the building.

■ Hillmann's initial assessment of the Financial Center Marriott occurred on September 18, 2001. Phase Contrast Microscopy (PCM) and Transmission Electron Microscopy (TEM) analyzed air samples ■ collected from the first floor of the Hotel in Roy's Restaurant, the adjoining kitchen and adjacent lobby. The results of the PCM air sampling indicated airborne fiber concentrations in excess of the New York ■ City established re-occupancy level (0.01 f/cc). The air samples analyzed by the more stringent Transmission Electron Microscopy (TEM) detected the presence of asbestos structures. The . concentration of asbestos structures was not found to be in excess of the New York City Re-occupancy level of 70 Structures per square millimeter. Subsequent analysis of the bulk dust/ debris collected from • the rooftops on various floors and lobby gift shop and analyzed using polarized light microscopy (PLM) were found to contain trace amounts of asbestos (<1%).

2.2 Conclusions and Recommendations

The evidence provided by the preliminary sample data collected from these locations indicated that a asbestos concentrations in bulk debris materials were not substantial enough to qualify the debris as an asbestos containing material (>1%). However, given the significant amount of debris in these areas, a Hillmann believed that the presence of the asbestos fibers in the debris could constitute a significant health hazard during the cleanup of these areas. Therefore, the recommendation was made to have these a

areas cleaned by a licensed asbestos abatement contractor using engineering controls to avoid the spread of debris and potentially contaminated air to other areas of the Hotel.

Based on the findings of preliminary air sampling and bulk debris analysis, CCMH Fin Center LLC a

decided that Roy's Restaurant, the adjoining kitchen and adjacent lobby would be cleaned by a licensed asbestos abatement contractor. During the licensed asbestos abatement contractor's clean-up of Roy's a

Restaurant, the adjoining kitchen and adjacent lobby, Hillmann conducted air sampling in these areas until the debris had been cleaned and New York City air clearance levels were obtained. i
