Dear Mr. R. Radhakrishnan:
This letter is to acknowledge receipt of your letter dated February 12, 2002 in which you requested we provide the NYC DEP with the results of bulk and air sampling that may have been conducted at the above facility prior, during and after the clean-up activities associated with the collapse of the World Trade Center. This letter is to inform you that we will comply with your request upon receipt of a report from our consultant summarizing the activities that were conducted at the property. We have requested a proposal from Hillmann Environmental who conducted the sampling and analysis and expect to have them under contract to complete this report within the next few weeks.
As you requested, below is a brief summary of the activities that occurred during the clean-up from September through December 2001.
CCMH Fin Center LLC ("Owner") is the current tenant of the facility. After being allowed into the facility in late September we mobilized Environmental Disaster Services ("EDS") and Hillmann Environmental to the project to assess the condition of the hotel. Hillmann observed a fine layer of dust in most public areas of the hotel and back-of-house areas having window or façade penetrations. Roy's Restaurant on the first floor in the northeast corner of the hotel was an exception to this observation. The windows of Roy's were blown out and there was measurable quantities of dust on every surface of the restaurant and associated kitchen. Hillmann collected random dust samples from the following areas of the hotel for asbestos analysis (PLM):
• Battery Park Tavern • Roofs on floors 4, 5 and 6 • window sills on the north, east and west side of the buildings on floors 7, 10, 15, 20, 25, and 30 • North edge of building roof • 4 floor corridor area adjacent to mechanical room • Flower & Gift Shop
