g. The Environmental Consultant shall issue a Certificate of Completion
• certifying that all conditions set forth in this Specification have been
satisfactorily completed.
11.0 Authority To Stop Work
11.1 JLC shall have the authority to stop work at any time when conditions are not
within the Specification requirements or applicable regulations. The stoppage
of work shall continue until conditions have been corrected to the satisfaction
of the Consultant or other authorized representative. Standby time required
to resolve violations shall be at the Contractor's expense.
SECTION THREE: EXECUTION
After the contract has been executed, a pre-construction meeting is to be attended by
the Owner, the Environmental Consultant, the Contractor (including an officer of the
company and the) and the Owner's representative (Building Manager, Chief
Engineer, Fire Safety Officer, and Secretary), at which the Contractor shall present in
detail the following:
1.1 Proof of the written notification in accordance with 40 CFR Part 61.146 of
Subsection M, to the appropriate state or l federal air pollution control agency
responsible for the enforcement of the National Emission Standard for
Asbestos at least ten (10) days prior to the commencement of any on-site
project activity. Provide the Owner(s) with a copy of the notice.
1.2 Any additional notifications as required 1 by governing bodies (NYC-DEP,
NYS-DOL).
1.3 Proof satisfactory to the Owner(s) that required permits, site location and
arrangements for transport and disposal of asbestos containing waste
materials have been made.
1.4 Documentation satisfactory to the Owner(6) that the Contractor's employees,
including foremen, supervisors, and any other company personnel or agents
who may be exposed to airborne asbestos fibers or who may be responsible
for any aspects of abatement activities, have received adequate training and
are properly licensed by the appropriate gencies. This includes NYC-DEP
and NYS-DOL licenses for each employee working on the site.
1.5 Documentation of respirator fit testing for all Contractor's employees and
agents who must enter the work area. This fit testing shall be conducted in
accordance with qualitative procedures as required by OSHA.
1.6 Physician's documentation that all employees or agents who may be
exposed to airborne asbestos In excess of background level have been
provided with an opportunity to be medically monitored to determine
whether they are physically capable of working while wearing the respirator
• required without suffering adverse health effects. In addition submit
documentation that personnel have received medical monitoring as required
by OSHA regulations. The Contractor must be aware of and provide
