AMBIENT AIR AND BULK SAMPLING REPORT

From October 17 through November 16, 2001 Applied Technology Services, Inc. (ATS) Vesey Street, 1st through 4t provided bulk sampling and ambient air monitoring services at 14 floors, New York, NY in various areas. ATS's services were requested by NY County Law Association, due to personal health and safety concerns.

ATS's inspection team consisted of Steve VanderWoude, certified NYSDOL Inspector, and Vladimir Pankov, NYSDOL Certified Project Monitor.

Air Sampling Analysis:

Transmission Electron Microscopy (TEM) with a 20,000x magnification is currently accepted as state of the art analysis. TEM is able to detect fibers 1/10 the size of those detectable via Polarized Light Microscopy (PLM) which has a 400x magnification.

Transmission Electron Microscopy (TEM) analysis was utilized to specifically rule out asbestos related hazards. Results of TEM analyses indicate asbestos structures detected were below the Asbestos Hazard Emergency Response Act (AHERA) Re-occupancy Level of 70 structures per square millimeter. Therefore, these areas may be re-occupied without the use of respiratory protection against airborne asbestos fibers at this time.

Bulk Sampling Analysis:

Disturbance of Asbestos Containing Material (ACM) must be performed according to Federal (OSHA/EPA), NYS Department of Labor (DOL) and NYC Department of Environmental Protection (DEP) regulations governing the treatment of asbestos. Results of analyses indicate that asbestos was present in various samples although not in percentages high enough (greater than 1%) to be regulated and classified as Asbestos Containing Material (ACM). However, the resultant classification of Non-ACM does not mean that there are no risks associated with the treatment of the area and materials. Remediation, if necessary, of asbestos contaminated furniture, equipment and areas should be performed by properly trained personnel wearing Personal Protective Equipment and utilizing Negative Air Filtration Devices and High Efficiency Particulate Air (HEPA) vacuums to insure public safety and health.

At this time results of sample analysis indicate that all areas tested are in compliance with New York City Department of Environmental Protection (NYCDEP) Regulations.
