Further to our correspondence of 6/11/2002 and as we indicated in our meeting last week, we have received more recent expedited test results from the ‘debris piles’ at 130 Liberty Street. As shown in the attached summary, the data confirm the presence of significant concentrations of dioxins, asbestos and metals and provides evidence of PCB contamination.

Exhibit A contains the analysis results for a number of organic contaminants that are known to be toxic ami'or carcinogenic. The results indicate that products of combustion, (dioxins and Poly Aromatic Hydrocarbons) as well as BCD’s are present in samples at very high levels from representative floors from the north side of the building, in the gash area and in the basement.

E.xhibit B contains the analysis results for asbestos, mercury and other heavy metals. The results indicate that asbestos is present throughout the building in amounts exceeding one per cent. Furthermore the asbestos is present in an extremely finely divided state with as many as 100 million structures per square foot. The finely divided nature of rhe dust makes disturbance of the material likely to produce very high exposures.

The results also indicate the presence of mercury, beryllium and several heavy metals in significant concentrations.

Based on these findings and other information available to the bank, this debris can only be disturbed in a controlled environment to prevent disposal into the environment outside the building. Disposal of the debris needs to be conducted in accordance with applicable law. Wc are commencing waste characterization tests on an expedited basis.

In conclusion, the latest results are scientific proof of the necessity to exercise the greatest care in handling of the debris. Therefore, we recommend scheduling a meeting to discuss this the proper and most expeditious way to achieve this objective.
