Dear Mr. Ward,
As promised in the meeting between Deutsche Bank representatives; the fire department, the Office of
Emergency Management, and the Department of Design and Construction on June 4 2002, Deutsche Bank
has compiled the results of preliminary tests from 130 Liberty which are attached.
Exhibit A contains the analysis results for a number of organic contaminants that are known to be toxic
and/or carcinogenic. The results indicate that products of combustion, (dioxins and Poly Aromatic
Hydrocarbons) are present in samples from representative floors from the north side of the building, in the
gash area and in the basement.
Exhibit B contains the analysis results for asbestos, mercury and other heavy metals. The results indicate
that asbestos is present throughout the building in amounts exceeding one per cent. Furthermore the
asbestos is present in an extremely finely divided state with as many as 100 million structures per square
foot. Tlie finely divided nature of the dust makes disturbance of the material likely to produce very high
exposures. The results also indicate the presence of mercury, beryllium and several heavy metals in
significant concentrations.
Exhibit C contains the results of bulk testing of visible microbial growth. The samples were collected on
two basement levels. An extensive suite of fungi and bacteria were identified including stachybotrys.
Based on these findings and other information available to the bank, its experts have recommended a
systematic testing program to quantify the nature of the hazard, methods for handling the material during
removal to protect workers and the public, characterization of the waste for disposal purposes, and
appropriate remediation processes.
