I have reviewed the Asbestos Control Program files related to the WTC cleanups. In reviewing sample results submitted by building owners at DEP's request, I was able to locate only three letters asserting that the results were exempt from public review under FOIL:
r • • • The NY Stock Exchange, for results of sampling at 11 Wall Street; Bovis Lend Lease, for results pertaining to the Millenium Hilton (41-51 Church Street, 172-184 Fulton Street) Capital Properties, for results of sampling at 111 Broadway, 2-10 Thames Street, 91 -95 Trinity Place, and 115 Broadway.
It should also be noted that many of the labs who performed sampling and issued reports use boilerplate language along the lines of "this report was prepared for the sole use of our client and may not be used by anyone else without our written consent."
I exchanged messages with Mr. Kupferman on Monday 12/30 and have not heard from him since. I am assuming that once we pull the results for the buildings listed above we can call Kupferman and invite them in to inspect the remaining submissions. Please advise.
