Dear Pll Thank you for the information in your correspondence.

The document was a scope of work forwarded to Mr. Stanke as a preliminary document and was not the report from my site visit. During the site visit on December 3, 2002,1 went into your apartment and the commercial spaces. The HVAC unit in the closet by the elevators was also observed.

Dear Ms Theodorellys:

My name is Pll . and I own a residential unit on the 3rd floor of 114 Liberty St., and I am also’on’the Board of Managers of the building. Your report is wrong as regards the 3rd floor. On that floor is a residential unit separated by a hallway from 2 commerical units. Furthermore, the report states that the Air Handler Units are "unknown". This too is incorrect. My apartment is part of the HVAC system and is centrally air-cooled. The condenser unit is in a closet by the front stairs next to the elevators. It is never locked so your personnel have unlimited access to it. Access to my apartment, unit 302, is simply a matter of obtaining keys from the various personnel who are always in the building, including Tony, Curtis, Donavin, or Chris Warnick, our architect.

Please do not make a serious mistake and ignore us. My wife and I have an 11-year-old child, and we want desperately to move back into 114 Liberty St., but it must be totally enviommentally safe. This means I assume you will undertake a complete cleaning of the commercial units and hallway bathrooms, etc on the third floor.

I need to hear from you that you have received this communication, and that you will amend your reports accordingly so that I can trust that the DEP will properly clean and remediate my apartment and will provide no less service to my home than it will to the larger full-floor units.

You cannot imagine how frustrating this entire process has become, not only being ignored by all the powers that be at Ground Zero, but to read a report that ignores my home even further.

Please make absolutely sure that your contractors know and understand this. As a member of the Board, I cannot vote to approve these plans until they are amended. I'm sure you understand. 1
