•Manner in which claim arose: I maintain that damage to my sewer lateral line and water line (which was detected when a sink hole opened near my property) was caused directly by the City's failure to maintain its vital Infrastructure-- especially the Cannon Attach extra sh Place retaining well, and that the city Is thereby responsible for my damaged property and the expense incurred. The community commissioned Its own engineer's report on the wall [attached] in 2010, which found that the asphalt on Cannon Place was breaking up as of "result of the retaining wail shifting and the volume of soil behind the retaining wall redistributing itself." (p.2) The City finally acknowledged that the Cannon Place retaining wall is in a dangerous state of disrepair and imminent threat of collapse. The DDC in partnership with DOT and DEP has commissioned a major capital project (RWX201). slated to being in Fall 2013, which will involve ripping up the entire street, replacing and moving the broken/aged water and sewer mains, replacing the entire retaining wall, and resurfacing end regrading the entire street. The DDC's own report on this project (attached) states that the rubble wall has significant bulges and that the concrete/asphalt on Cannon Place s *tilting.» t is dear to me that the lifting' of Cannon Place and the resulting constant downward pressure have fractured my hewer/water lines, resulting in an expensive repair. The City has been well aware of the pervasive structure issues :annon Place (which also Include broker sewer mains and poor grading which allows water to pool in vulnerable treas) and has failed to act to protect our property and out safety. n 2010 DOT installed heavy concrete jersey barriers on the most vulnerable spat, which added to the problem. )EP representatives who came to our home repeatedly refused to identify themselves, and gave us no written iotification regarding the necessary repairs. :ouhcilman Oliver Koppell's concurs that this damage was caused by the city's failure to maintain, seek recompenaation for my out-of-pocket expenses related to my damaged pipes.
