.—---------- --------- ---- ------- -------------------------------- ----------------- —------------------- •Manrrer in which claim arose: I maintain that damage to my sewer lateral line and water line (which was detected when a sink hole opened near my property) was caused directly by the City's failure to maintain its vital Infrastructure- especially the Cannon Attach extra sheettsi retaining wall, and that the city is thereby responsible for my damaged property and the expense incurred. Ifinoreroom is The community has repeatedly put the city on alert regarding the danger of this retaining wall, which suffered needed. major partial collapse In the past. The community commissioned hs own engineer's report on the wall [attached] in 2010, which found that the asphalt on Cannon Place was breaking up as of "result of the retaining wall shifting and the volume of soil behmd the retaining wall redistributing itself." (p. 2) The Ot>' finally acknowledged that the Cannon Place retaining wall is In a dangerous state of disrepair and Imminent threat of coflapse. The DDC in partnership with DOT and DEP has commissioned a major capital project (RWX201). slated to being in Fall 2013, which will involve ripping up the entire street, replacing and moving the bmken/aged water and sewer mains, replacing the entire retaining wall, and resurfacing and regrading the entire street. The DDC's own report on this project (attached) states that the rubble wall has significant bulges and that the concrcte/asphalt on Cannon Place is "tilting." It is dear to me that the "tilting" of Cannon Place and the resulting constant downward pressure have fractured my sewer/water Unes, resulting In an expensive repair. The City has been well aware of the pervasive structure Issues Cannon Place (which also include broker sewer mains and poor grading which allows water to pool in vulnerable areas) and has failed to act to protect our property and our safety. tn 2010 DOT installed heavy concrete jersey barriers on the most vulnerable spot, which added to the problem. DEP representatives who came to our heme repeatedly refused to identify themselves, and gave us no written notification regarding the necessary repairs. Councilman Oliver Koppeli’s concurs that this damage was caused by the city's failure to maintain, I seek recompensation for my out-of-pocket expenses related to my damaged p ipes.
