SUSPENSION OF REGULATIONS RSGARDINQ TRANSPORTATION AND HANDLING
OF CERTAIN SOLID WASTE RESULTING FROM THE WORLD TRADE CENTER
DISASTER
WHEREAS, on September II, 2001, I Issued Executive
Order Number 113 declaring a disaster emergency in the State of
New York;
NOW, THEREFORE, I, GEORGE E. PATAKI, Governor of the
State of Hew York, by virtue of the authority vested in me by the
Constitution and Laws of the State of Hew York, do hereby
continue Executive Order Ho. 113, dated September 11, 2001,
except that such Executive Order is amended to read as follows:
FURTHER, purauant to the authority vested in roe by
Section 29-a of Article 2-B of the Executive Law to temporarily
suspend specific provisions of any statute, local law, ordinance,
orders, rules or regulations, or ports thereof, of any agency
during a State disaster emergency, if compliance with such
provisions would prevent, hinder or delay action necessary to
cope with the disaster, I hereby teogjorarily suspend, for the
period from the date of this Executive Order until further
notice, the following regulations:
£ NYCRR part 364 to the extent that this part requires
persons working under the supervision of government officials of
the state and/or City of Hew York in connection with the disaster
emergency to obtain permits for the collection, transportation
and delivery of regulated waste to the staging areas or disposal
locations owned or operated by the City of New York/
6 NYCRR parts 310 through 374 and part 376 to the extent
that these parts require persons working under the supervision of
government officials of the State and/or City of Hew York in
connection with the disaster emergency to coimply with hazardous
waste management standards at the disaster site, during the
transportation of such waste fron, the disaster site to staging
areas or disposal locations owned or operated by the City of New
York, and in connection with ^-he^storage of such waste at these
staging areas or disposal locatxonfex.
