RE: Freedom of Information Act ("FOIA") Request Information and Data from World Trade Center/Ground Zero Monitoring Activities
Dear Sir or Madam:
This letter will serve as a request pursuant to the Freedom of Information Act ("FOIA") to review, and to secure reasonable copies of, the following environmental information, data, reports and files in the possession of the New York City DEP (including information collected by other agencies or contractors) concerning the World Trade Center / Ground Zero rescue and recovery activities, including all samples collected inside and outside the Ground Zero police perimeter, and from other locations in Manhattan; Hudson and Bergen Counties, New Jersey; Brooklyn, Staten Island and Queens as noted below. This request pertains to the timeframe beginning September 11,2001 through the current time.
I understand that the United States EPA is directing your office to redirect requests for information directly to the USEPA. I have contacted them separately and I am hopeful that information regarding the NYCDEP's sampling results and protocols are available through the USEPA. However, this letter will fulfill the requirements of the Freedom of Information Act to request access to any sampling data, protocols or information pertaining to Ground Zero that for whatever reason, has not been forwarded to the USEPA.
It is apparent that considerable asbestos testing has been ongoing by the NYCDEP. However, in case die NYCDEP has collected information beyond asbestos, we are requesting access to this additional data. This data may consist of i) air, dust, bulk and wipe samples; ii) surface water, stormwater and firefighting runoff samples; drinking water samples (for samples collected within 3 blocks of the northern perimeter of Ground Zero); and iii) datalogs for direct reading instruments used for participate and VOC sampling, if any.
More specifically, we are looking to review the following information, if available:
• DRAFT or FINAL backup laboratory reports (including cover pages, chains of custody forms, results pages, and all quality assurance / qualif 'unaol data deliverables) for all envir'^nmental monitoring data presented on the website www.ci.nvc.nv.us/html/dep/home.hthil and any data not presented, for i) dioxins and furans, including all isomers; ii) VOC's, SVOCs, and PAHs, including any non-target scans or library searches; iii) PCBs; iv) any other GC/MS or other laboratory testing; and v) asbestos, fiberglass or other parameters.
