1. EPA is waiting to hear from Washington for further direction as per the EPA talking point memo (sent Thursday under separate cover).

2. Scopes seem to be closer to completion; that is, no more significant changes. DEP will review on Monday to correct discrepancies between air scope and cleanup scope.

a) DEP and FEMA Legal Departments want to review final scopes before contracting process starts.

b) Changes made to scope over the last week include:

■ Requiring ceiling and walls to be included in common space cleanup. ■ Residents will now have the option of having impermeable walls and floors wet wiped. ■ Materials that cannot be effectively cleaned as identified by EPA, may be disposed of (as ACM waste) with authorization of the owner. ■ The addition of wipe samples for dioxin, total metals and mercury up to a max of 50 units. ■ Requiring air samples to be taken in common areas after cleanup. ■ Personal air monitoring turn around time within 24 hours of collection (OSHA wanted this).

3. These additions added to the cost of die matrix. FEMA staff has been notified verbally of the matrix change and DEP will send out the revised matrix by end of the day. Total dollar difference is $3.IM.

4. NYS Attorney General’s Office met with EPA and expressed concerns regarding lead (actually lead paint) in people’s apartments. Additionally, they believe that all cleanups have to be treated as minor asbestos projects and thus DEP/DOL regulations apply. This is not our view or EPA’s. I have forwarded all the relevant materials to Russell Pecunies with a copy to Mark Hoffer. EPA’s Legal Department is speaking to the Attorney General’s Office.

5. EPA’s pilot cleaning project being conducted at 110 Liberty Street expects to be completed by the first week in August. No sample results are available, however, the project manager seems happy with the progress so far. The results will be more telling.

6. We are still drafting the bid sheets for the scopes. Air monitoring is completed and cleaning still undergoing modifications. Once finalized, they will be
