The Department of Environmental Protection (DEP) handles asbestos complaints, emergencies and
certifications and oversees the remediation of asbestos and lead. The agency also handles complaints,
remediation and clean-up of industrial waste (oil, grease, gasoline or other explosives, paint chemicals,
and wastewater).
DEP regulates stationary sources of air and noise pollution in the City. DEP is responsible for regulating
toxic materials and has designed individual programs to address the problems of lead paint remediation,
asbestos, hazardous materials and industrial waste. DEP enforces the part of the City Health Code which
allows for inspection of remediation of lead paint. DEP also provides free testing of drinking water
samples from New York City residences to determine if lead may be leaching into water from the solder,
fixtures and pipes found in the plumbing of some buildings.
The Air Pollution Control Code and Local Law 76 of the New York City Charter requires property
owners to notify DEP whenever asbestos is to be disturbed as part of demolition or renovation work.
DEP is responsible for enforcement, training and technical review of all asbestos related projects. DEP
also certifies workers, supervisors and inspectors in the asbestos abatement industry. Specifically, DEP
