PRELIMINARY STATEMENT

The New York State Conference of Mayors and Municipal Officials respectfully submits this

memorandum of law amicus curiae in support of the Defendant-Appellee City of New York which requests

that the Court answer in the negative the question certified to it from the 2nd Circuit Court of Appeals,

namely, "Does any aspect of the proposed WTP require state legislative approval?"
