WESTCHESTER DIVERSION

Bullet Points

I. Westchester blind-sided DEP staff at meeting on 7/6. Meeting was supposed to discuss (and narrow differences on) amount of $ City was contribute UNDER MOA 140(1) towards diversion of

Yorktown Riverwoods Random Farms

140(l) amount is the "avoided upgrade cost" (that is, what the City is no longer obligated to spend to design and construct the necessary upgrades at the above plant - CAPITAL ONLY - no O&M piece).

2. County instead pronounced list of pre-conditions to diversion

* City pays for whole project:

capital cost of diversion project cost of expanding Peekskill (technically not necessary) O&M of project facilities host'community benefits (i.e, goodies) to Peekskill

County was unclear about costs (used different numbers at different times), but appeared to be asking for

$ 26 Million for capital $25 Million for Peekskill expansion and host community benefits (and perhaps another $5-10 Million for goodies) $1 Million per annum for O&M

* County will contribute nothing out of the East of Hudson fund ($38 Million) paid to County under MOA - despite fact that diversion was preferred use discussed in negotiations, and first (of several) permitted uses listed in MOA

* County has other diversion projects it wants to do; expects City to pick up all costs on those as well.

* County says City should pay for all of this, but this is what County thinks the City should do to protect the health of its citizens
