NYC 9/11 Public Portal Document

A total of$1,729,337.08 (this total includes interest) was sold in the lien sale which included water and sewer charges open at the DeparhneutMiipsjtc_..An additional $693.06 on account _ Pi _ and $1,019.77 on account` PII 'svaa sold as unpaid water and sewer charges billed by DEP.

In conclusion, I find that the charges billed were based on actual tatter readings, with the exception of one bill. The bill that was estimated should a lower iverage daily consumption than actual bills during the period. The type of commercial activity (ft.bric dyeing) carried out at this location is a high consumer of water and therefore, I can find no reason to declare the charges to be invalid and I cannot declare the lien to be defective.

The NYC Water Board allows for an appeal of my decision to their Executive Director. I have detailed the appeal process below for your information.

If circumstances within the control of the customer, including but not limited to failure to provide access to a premise or a meter, prohibit the Executive Director from making a decision, he customer shall be notified in writing stating why a decision cannot be rendered. If the Executi ee Director determines that the questioned charges are correct, the charges shall be due and payable as set forth on the bill and/or delinquency notices. If the questioned charges are determined to be incorrect, appropriate remedial action shall be taken including the issuance of cancellations and/or corrected bills, and providing information relating to requests for refunds or credits.
