NYC 9/11 Public Portal Document

Chapter 3Q, Air, was updated to account for the latest known technical guidance with respect to pollution associated with various types of motor vehicles. Guidance on how to perform a cumulative analysis from 'stationary sources was added. Finally, since cars generate less pollution than in the past, thresholds to the number of vehicles that trigger an analysis were increased from 10 autos per hour to 50 in certain areas.

Chapter 3R, Noise, updates include changes in recommended analysis using different values and methodologies. Chapter 3S, Construction Impacts, was updated to reflect current contacts and practices.

Chapter 3T, Public Health, updates include that a public health assessment should look at not only actions for which the potential impact results in an exceedance of accepted Federal, State or Local standards, but also at actions which might not exceed the preceding thresholds, but might result in significant public health concerns, including projects such as the Adult Mosquito control programs and the NYC Comprehensive Solid Waste Management Plan and the Lead Paint Removal Operations on the New York City Department of Transportation Bridges. -

The Small Task Force agreed to adding language regarding considering impacts beyond exceedance of standards. City Planning objected. The Law Department believes it is necessary to make the chapter legally defensible. The additional language in the Public Health chapter is compromise language that was agreed to by all agencies including the Department of Health and the Department of City Planning. In fact, the Law Department believes this language makes the assessment legally defensible.

Chapter 3U,Alternatives and Chapter 3V, EIS Summary Chapters, had no changes.

Overall, it should be noted that all changes have been vetted by numerous, accountable sources, and the Law Department has agreed to all changes. Should you want additional details on any of the changes described above, please feel free to call.
