Ac appropriate applicarion and Flint; fee for these now tanks has teen with NYSDEC along with a certification from a professional engineer, verifying that the tacks were installed in conformance with Bulk Storage Regulations. However. I Sea Still not able to operate the service station that I have spent over $250,000.00 in improvements over the last 12 months, due to NYSDEC delay in processing the registration.
I am a tenant of the eforcmentioned property since 1997. Some contamination was discovered at my business when the Sank replacement occurred in the winter of 2000. However, this eonren,in Lion is historical, occurring prior to cornmencernent of SnY tenancy in 1997 c4 dsttvtg back at lest 8-15 years, based upon the expert opinion of Dr. William Sawyer, A noted forensic expert specializing in evaluating petroleum di'schntge history.
Even though 1 believt: that the party vsponsible for the contamination is the owner or price operator, I have paid for the removal of four (4) underground storage tanks (only two of which I used, a third the Ieaelard and or prior operators abandoned and took our of service in 1992 due to a spill, see DEC Spill NO.9211785, and a fourth mystery tmk.) I have also paid for the removal of two (2) smaller woks ( a waste oil and heating oil tank) abandoned prior to my tennxicy 3frd aloe paid far an environmental invesrigaticn using gcoprobes and lab aaslysis supervised by DEC persutSl.
Even assuming a discberge occurred which I could be liable for as a result of activities during my tanancy, (which I can establish did not occur). it still does not explain why there is a continuing isstto related to the rc9LslZati*n of erg stew tanks orhow other swice
