intent that tax, or interest or penalties thereon, shall be

evaded, and any such person shall be subiect to a penalty equal

to two hundred percent of any otherwise applicable additions to

tax. The penalty imposed under this subdivision shall be in

addition to any otherwise applicable additions to tax. The

commissioner of finance shall have the power, in his or her

discretion, to waive, reduce or compromise any penalty under this

subdivision d.

e. Any person who, with the intent that tax, or interest or

penalties thereon, be evaded, shall, for a fee or other

compensation or as an incident to the performance of other

services for which such person receives compensation, aid or

assist in, or procure, counsel, or advise the preparation or

presentation under, or in connection with any return, amended

return or claim for credit or refund containing a material

misrepresentation of fact in connection with claiming the

benefits of this section, or make a material misrepresentation of

fact in connection with claiming the benefits of this section for

return, amended return or claim for credit cr refund, whether

or not such misrepresentation is with the knowledge or consent of

the person authorized or required to present such return, amended

return or claim for credit or refund, shall pay a penalty not

exceeding ten thousand dollars.

§ 2. This act shall take effect immediately.
