SCOPE OF WORK
Tully Construction Company, Incorporated (Tully) was hired by DDC, as one of four Construction Managers (CMs), for removal of
the concrete, steel and other mixed debris from designated areas within the WTC complex. The debris removal and associated work,
unless otherwise noted, was performed on a time and materials basis at the WTC complex pursuant to a draft contract with DDC. The
work was both self-performed and performed by subcontractors and/or consultants hired by AMEC. Further, from time to time DDC
has issued clarifications to the contract and City procedures. These clarifications have been accumulated by DDC in a project specific
binder(s) called the "Poll / roc k." These clarifications take precedence over the draft contract. Also, the contract
requires certain approvals byte City, ie,staffing plans, billing rates, bid procurements, etc.., these also have been accumulated by
DDC for this specific project and is referred to as the "Approvals Book".
This PW has been written for debris removal contract work completed during the period of 9/I 1/01-4/12/02. While Tully has
submitted payment requisitions for this period detailing their actual costs incurred, DDC has not completed its final review of the
requisitions. The DDC has previously provided nine (9) payments totaling S60,500,000 to cover a portion of Tully's projected costs.
