that the openings remain covered during the course of the work. The ATC consultant also confirmed that there was no visible release of any debris into the hallways on those floors where the plastic became loose.

5. Due to the need to access every apartment for the work to be beneficial, we will consider this a critical maintenance condition to the extent that we will let the contractor staff into each apartment if you are not home. We will of course keep you informed of the approximate schedule of units to be addressed so you may arrange to be home if that is your preference.

6. The contractor will use hepa vacuums, pneumatic brushes, surfactant wipes and airless antibacterial sprays in the process. The work will proceed on a vertical line basis on a 6 day per week schedule for a period that may take up to 4 weeks.

7. We have asked ATC to return to the building on the 19th of December and on the 2°d of January for the express purpose of extending our testing of apartments during the period of the vent cleaning. The sign up method for any resident that requests one will continue.

8. The exterior cleaning of the building continues. We estimate completion to be by the end of December.

We received a letter signed by a few residents dated December 8, 2001 that we believe was also sent to all residents of Tribeca Tower as well. We believe this letter contained several inaccuracies and substantial omissions which we would like to respond to publicly and openly.

• We have already spoken to one of the residents who signed the letter and have agreed to stop the duct cleaning until the residents can identify an "expert representative" to meet with our consultant and contractor. We have made it clear that we want to proceed as soon as possible and want to set up the meeting immediately. However, as of last evening, the resident group had not identified who their "expert representative" would be. We are confident that any review of the cleaning protocol and the qualifications of our contractor and consultant will satisfy the professional interests of any representative provided, and will give comfort to you. • All the air testing performed in the apartments followed the AHERA standard protocol and did not require specific preparation by the resident or efforts to change normal behaviors during the test period. • We have performed air testing on an ongoing basis even though there was no evidence of need other than to provide comfort to our residents. • We have had no indication from any testing result we performed OR from any testing result performed by a public agency or other qualified source of a single condition that requires us to proceed where we have not done so. • All of the contractors we brought to this property to perform any portion of the work have been fully qualified to do so.
