City of New York Department of Design and Construction

January 18, 2002

Mr. Brian Peters Senior Project Manager Bovis Lend Lease Inc. 60 East 42“* Street 29**' Floor, Suite 2925 New York, New York 10165

Dear Brian:

I have received and reviewed copies of the three transmittals from Mooretrench American Operation (Mooretrench) reported to me in your letter dated 1/18/02. These samples were collected after receiving a report of 200 ppb of MTBE from a sample taken on 12/31/01 by Mooretrench and analyzed by Independent Test Labs. All three letters (01-4906-36,01-4906- 37, and 01-4906-35) submitted by Mooretrench reference the same water sample taken on 01/09/02 and all of the data in the three letters are the same. The report as submitted is unacceptable for the following reasons:

• The analysis results sheet does not reference the sample identification number and the sample date.

• The referenced action level refers to a soil clean-up objective not a limit for discharge to the NYC sewer system.

Please have the laboratory resubmit the test results. Should you have any questions, please do not hesitate to call me at 646-772-3984.

Regards,

Bruce L. Rottner
