7. DSI agrees cJ purchase and maintain and to pay the premiums for public liability insurance insuring itself and OEM against claims for damages because of or resulting from any injmy to property, person, or loss of life arising out of DSI performance of the WORK, with limits of at least One Hundred Thousand Dollars ($100,00.00) for property damage to OEM or third parties. Five Hundred Thousand Dollars ($500,000.00) for injury or death of one person and Chie Million Dollars ($1,000,000.00) for all injuries or deaths arising out of or resulting from any one accident. DM shall furnish to OEM, as OEM may request from time to time, memoranda or certificates showing such insurance as the issuing company may provide. DSI shall not cause such insurance coverage to be terminated without ten (10) days prior written notice to OEM. 8. DSI agrees to Indemnify and save OEM harmless against and from any and all claims, damages, cost and expenses, including reasonable attorney's fees, arising from the conduct, management or performance of the WORK, or from any act or negligence of DSI, its agents, contractors, servants or employees during the performance oftheWOBK. 9. In the event that cither party should default in porfonnlaK any of the obligations imposed upon it by any portion of this agreement, inciudixig, without limitation the failure to pay DSI any monies as herein si»ecifled and the failure by DS to perform any of it’s obligations hereunder, diet and in said event, the defaulting party agrees to pay to the other it's reasonable attorney's fees and costs incurred by it in enforcing its rights hereunder.
