In accordance with the written Agreement dated as of Oct. 24, 1997, between the Silverstein Properties, Inc. and the Architect, Swanke Hayden Connell & Partners LLP , for the following Project: Mayor’s Office of Emergency Management (OEM) Emergency Operations Center: 7 World Trade Center NY. NY

Tha Owner agrees and hereby authorizes Swanke Hayden Connell & Partners to X Proceed with Additional Services X Proceed with revised Scope of Sendees X Incur Out-of-Pocket Expenses

As follows: OEM' DCA.S requested the lo Hew ing revisions in scope in connection to the addition of Microwave Dish location on the Roof: SHCA reviewed the field conditions with OEM & Motorola to determine alternate roof locations for approval by Silverstein Properties, Inc, SHCA issued memos and sketches for the review and approval of alternate locaoon 'B'. SHCA will coordinate witli engineers and consultants to issue architectiual/engineering drawings required lor this scope. Drawings/sketches will not be issued to the Port Authority. Should the project need to be re-f’led with the Port Authority, the fees and out-of-pocket expenses associated with this submission will be an additional service.

Compensation to the Architect shall be adjusted as fcilovs: Fee. S 2,525 Out-of Pocket Expenses: $ 252 (Not-to-Exceed) T ime for performance shall be adjusted as follows: N/A

Upon return of a fully executed authorization, this service shall become part of the Agreement identified above. In the event that, alter transmittal of this Agreement to the Owner, payments to the Architect are made by the Owner after performance of any of the services called for herein, the Owner will be deemed to have accepted all terms of the Agreement not otherwise objected to.
